Driver Charged With the Passing of Matthew and Johnny Gaudreau Gets Update on His Sentencing

Sean Higgins, the driver who hit and killed the Gaudreau brothers, appeared in court today and will remain in jail as the legal process continues to serve justice for the Gaudreau family.

Higgins has been in a Salem county jail since the incident took place on the night of August 31st. His initial court hearing came on September 5th, where he was arraigned and held without bail.

However, the legal process must be very thorough and as such it is often quite long. Higgins has already made a couple more court appearances since then including a hearing last month where he was officially charged with two counts of death by auto.

His latest court apperance resulted in a 30-day extension period granted by the judge as the court awaits further discovery from New Jersey police.

In other words, local law enforcement is still investigating the incident and needs more time to present further evidence to the court.

It seems fairly obvious that it was Higgins who ran into the brothers on their bikes. However, at this moment he is still only facing the two charges.

Based on what we know about this case though, he could face additional charges including reckless driving and driving under the influence, which could extend his stay in jail.

At this time, there has not been another court date announced. We can assume it will come some time next month at the earliest, but with the Holiday season coming around, we may very well have to wait until the early days of 2025 to get another update on the case.

Currently, we are still in the pre-trial phase. Higgins is set to face a grand jury once the case finally goes to trial, unless some kind of plea agreement is made before that point.

So far, there are no indications from either side that that will happen. Be sure to stay tuned over the coming months as we learn more about the case.
